Terms and Conditions for Plank Construction
1. Scope of Work
The contractor agrees to perform the work as described in the attached estimate. Any additional work or changes to the scope must be documented in writing and may result in additional charges.
2. Estimates and Pricing
The provided estimate is valid for 30 days from the date of issuance. Prices are based on current material and labor costs and may be subject to adjustment if significant price changes occur prior to the start of the project.
3. Payment Terms
A deposit of 50% is required to secure the start of work, payable upon acceptance of the estimate.
Final payment is due upon satisfactory completion of the work.
For longer projects, a milestone payment agreement may be put in place. Failure to make timely payments may result in work stoppage and/or additional fees for late payment, typically 10%.
4. Materials and Subcontractors
The contractor may use subcontractors for specialized work and shall provide quality materials in accordance with industry standards. The customer will be notified in advance if specific materials are unavailable, or substitutions are required.
5. Permits and Regulations
The contractor will obtain necessary permits and comply with local building codes. However, any delays caused by the permitting process will be communicated, and timelines may be adjusted as necessary.
6. Site Access and Conditions
The client agrees to provide adequate access to the job site during normal working hours. The client is responsible for ensuring the site is safe and free of hazards. The contractor will take reasonable precautions to minimize disruption, but the client acknowledges that certain disturbances (such as noise, dust, and debris) may be unavoidable.
7. Project Timeline
The contractor will make every effort to complete the project by the estimated completion date. However, the contractor is not responsible for delays caused by factors beyond their control, including weather, material shortages, or unforeseen conditions on-site.
8. Warranty and Liability
The contractor warrants that all work will be performed in a good and workmanlike manner and will be free from defects in materials and workmanship for a period of one year from the date of completion. The warranty does not cover:
Normal wear and tear
Damage caused by misuse or neglect
Modifications or repairs by third parties
Liability for any damages caused by the contractor is limited to the total amount of the contract.
9. Change Orders
Any changes to the scope of work, including additional tasks or alterations to materials, must be requested in writing. The contractor will provide a revised estimate for any additional work, which must be approved by the client before proceeding.
10. Termination
Either party may terminate this agreement with written notice. In the event of termination, the client agrees to pay for work completed to the date of termination, including materials and any incurred costs.
11. Dispute Resolution
In the event of a dispute, both parties agree to first attempt resolution through informal discussions. If unresolved, the parties agree to mediation or arbitration before pursuing legal action.
12. Force Majeure
The contractor is not liable for delays or failures in performance due to events beyond their control, including but not limited to natural disasters, strikes, or pandemics.
13. Acceptance
By accepting this estimate, the client agrees to the terms and conditions outlined above. Any deviations from these terms must be agreed upon in writing by both parties.
